Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "User") and LingoTouch ("LingoTouch", "we", "our", or "us") governing your access to and use of the LingoTouch application, websites, and related services (collectively, the "Service"). By creating an account, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Eligibility

The Service is available to users of all ages, including children. If you are under the age of majority in your jurisdiction (or under 13 in the United States, under 16 in the EEA/UK, or the equivalent local age threshold elsewhere), you may only use the Service with the verifiable consent and active supervision of a parent or legal guardian, who accepts these Terms on your behalf and remains responsible for your use of the Service. We may decline to provide the Service to any user at our discretion where required by law.

2. Accounts and Security

You may be required to create an account or use a guest session to access certain features. You agree to provide accurate and current information, to keep your credentials confidential, and to promptly notify us of any unauthorized access. You are responsible for all activities that occur under your account. We may suspend or disable credentials that we reasonably believe have been compromised or used in violation of these Terms.

3. License to Use the Service

Subject to your compliance with these Terms, LingoTouch grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your personal, non-commercial learning purposes. All rights not expressly granted are reserved.

4. Acceptable Use

You agree not to, and not to permit any third party to:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent such restriction is prohibited by applicable law;
  • interfere with or disrupt the integrity, performance, or security of the Service, including by introducing malware, automated scraping, or circumventing rate limits or access controls;
  • use the Service to upload, generate, or transmit content that is infringing, defamatory, obscene, harassing, or otherwise objectionable;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • use the Service to train or develop competing machine learning models or datasets.

5. User Content and Voice Recordings

The Service includes features that record your voice input and other learning interactions ("User Content") to evaluate pronunciation, deliver feedback, and improve the Service. You retain all rights you may have in your User Content. You grant LingoTouch a worldwide, royalty-free, non-exclusive license to host, process, reproduce, and transmit your User Content solely as necessary to operate, secure, and improve the Service, and to perform statistical analysis in an aggregated or de-identified form. We handle User Content in accordance with the Privacy Policy.

6. Subscriptions, Billing, and Auto-Renewal

Certain features require a paid subscription ("Subscription"). Subscriptions are sold through the Apple App Store, Google Play, or other authorized channels. Prices, billing cycles, and available plans are disclosed at the point of purchase.

  • Auto-renewal. Subscriptions automatically renew for successive periods of the same length at the then-current price unless you cancel at least 24 hours before the end of the current period.
  • Cancellation. You can manage or cancel your Subscription at any time through your Apple ID, Google Play account, or other channel where the Subscription was purchased. Cancellation takes effect at the end of the current billing period.
  • Free trials. If a free trial is offered, unused portions of the trial are forfeited when you purchase a paid Subscription.
  • Refunds. Except where required by applicable law (including the EU right of withdrawal or similar statutory rights), payments are non-refundable and are governed by the refund policy of the store through which you purchased. Contact the relevant store directly to request a refund.
  • Price changes. We may adjust Subscription prices with prior notice through the app or email. Changes will take effect no earlier than the next renewal period; your continued use of the Subscription after the effective date constitutes acceptance of the new price.

7. Intellectual Property

The Service, including all software, text, audio, graphics, illustrations, characters (such as our mascot), trademarks, and curricula, is owned by LingoTouch or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license in Section 3, these Terms do not grant you any right, title, or interest in or to the Service.

8. Third-Party Services

The Service may integrate with third-party platforms (e.g., app stores, analytics providers, speech-recognition providers, payment processors). Your use of such third-party services may be subject to separate terms and privacy policies, and LingoTouch is not responsible for their content, practices, or availability.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that learning outcomes will meet any specific expectation. Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded or limited under applicable law.

10. Limitation of Liability

To the maximum extent permitted by law, LingoTouch and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the amounts you paid to LingoTouch for the Service in the twelve (12) months preceding the event giving rise to the claim. These limitations do not apply to liability that cannot be limited under applicable law, including liability for death, personal injury caused by negligence, fraud, or gross negligence.

11. Indemnification

You agree to defend, indemnify, and hold harmless LingoTouch and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Service, or your infringement of any third-party right. This section does not apply to consumers to the extent prohibited by applicable law.

12. Termination

You may stop using the Service at any time and may delete your account through the in-app settings. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination (including Sections 7, 9–11, and 14) shall survive.

13. Changes to the Service and the Terms

We may modify the Service at any time, including adding or removing features. We may also update these Terms from time to time. If we make material changes, we will provide notice (for example, via in-app notification or email) and update the "Last updated" date above. Changes take effect when posted, or on a later effective date specified by us. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms; if you do not agree, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which LingoTouch is established, without regard to its conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the competent courts located there, except where mandatory consumer-protection rules of your place of residence provide otherwise. Nothing in these Terms limits any mandatory statutory rights you may have as a consumer, nor your right to bring proceedings in the courts of your country of residence where applicable law requires.

15. Apple App Store Additional Terms

If you downloaded the Service from the Apple App Store, the following additional terms apply: (a) these Terms are concluded between you and LingoTouch only, and not with Apple; (b) the license granted herein is limited to use on Apple-branded products that run iOS or iPadOS; (c) Apple has no obligation to furnish any maintenance or support; (d) Apple is not responsible for any product warranties and, in the event of any failure to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
